Back-to-Back Colorado Supreme Court Victories

Danny Foster and Chip Schoneberger recently secured a second victory in the Colorado Supreme Court for their client, Jose Garcia, in his long court battle against Colorado Cab Company (aka “Yellow Cab”). In 2017, Foster secured a nearly $1 million jury verdict for Mr. Garcia in Denver District court. Yellow Cab appealed to the Court of Appeals, triggering 6 years of appellate litigation. Although the Court of Appeals twice reversed the jury’s verdict, FGMC appellate partner Schoneberger convinced the Colorado Supreme Court to review and reverse both decisions. The Supreme Court agreed with all of FGMC’s arguments along the way and ultimately reinstated Mr. Garcia’s jury verdict in full. With interest Mr. Garcia’s judgment will exceed $1,260,000. The Garcia case also created new tort law in Colorado under the “Rescue Doctrine” and firmly cemented the concept that proximate cause of injury is a factual issue for the jury. We are so pleased for Mr. Garcia and awed by his perseverance and patience while this matter played out in the appellate courts.
